How long a bookmaker may take to pay out in Kenya under the Act and the 2026 Regulations

Section 70(1) of the Gambling Control Act, 2025 gives a licensee two days to credit a monetary win to your betting account. Payment then follows the Third Schedule to L.N. 112: prizes up to KES 500,000 immediately, larger prizes within five, fourteen or thirty working days. Winnings unpaid after fourteen days attract penalties under r.101.

Kenyan law starts two clocks after a winning bet: one for crediting the win to your betting account, and one for paying a prize out to you. Section 70(1) of the Gambling Control Act, 2025 gives a licensee two days to credit a monetary prize won online. The Third Schedule to the Conduct of Gambling Operations Regulations, 2026 (L.N. 112) then sets payment deadlines by prize size.

Several of those deadlines start only once identity checks are complete, because a winner must be verified before payment. What is checked, and how to unblock a stalled check, is covered in betting account verification in Kenya.

What the Act says about crediting a win

Section 70(1) reads: "Where a player in an online gambling transaction wins a monetary prize, a licensee shall within two days credit the amount to the player's account." The account meant here is the player account that section 73(1) requires a licensee to keep for each registered player.

Three other sections frame the cash-out. Section 69 says an online gambling transaction concludes when the player withdraws money from the gaming account. Section 75(b) lets the licensee remit funds standing to your credit at your request, and section 76(1) has player money paid into a bank account or mobile money, or in cash on request.

A non-monetary prize follows its own rule. Section 70(2) gives the licensee seven days to deliver it, or to tell you in writing of an address in Kenya where you can collect it.

The payout deadlines in the 2026 Regulations

Regulation 85(2) of L.N. 112 requires a licensee to process punters' payments according to the payment structure in the Third Schedule. Regulation 24(1) adds that winning bets must be settled "promptly and in accordance with the published rules".

Prize (KES)How it is paidChecks before paymentDeadline
Up to 500,000Automatically, to your registered mobile money wallet or betting accountBasic identity verificationImmediately
500,001 to 5,000,000Mobile money or bank transferGovernment-issued ID, ticket ownership, basic anti-money laundering checksWithin five working days
5,000,001 to 50,000,000Bank transfer onlyFull identity verification, ticket authentication, enhanced anti-money laundering checks; in-person or secure video check where necessaryWithin fourteen working days after verification is complete
Above 50,000,000 (jackpot)Secure payment arrangements; structured payout options may be offeredVerification, with financial counselling offeredWithin thirty working days after verification is complete

Two general rules cover every tier. A prize may not be paid until lawful ticket ownership has been verified, and the Authority may issue guidelines that add controls, verification steps or payment procedures for any tier.

The top two tiers count working days from the end of verification, not from the day you win. The schedule sets no deadline for the verification step itself, so a slow check pushes those dates back.

What if the bookmaker pays late?

Regulation 101(1) makes a licensee that fails to pay winnings within fourteen days liable to a penalty of 5% of the total winnings, payable to the Authority. Under r.101(2) it must still pay you the outstanding winnings plus interest of 5% per day from the end of those fourteen days, for the next twenty-one days, until payment in full. Regulation 101(3) adds that non-compliance may lead to suspension of the licence.

Illustrative example. A bookmaker owes you KES 100,000 that is still unpaid after fourteen days, so the r.101(1) penalty owed to the Authority is 5%, or KES 5,000. Read as simple interest, r.101(2) adds KES 5,000 owed to you for each day the money stays unpaid within the next twenty-one days.

The Regulations do not say whether that interest compounds. They also do not explain how the fourteen days in r.101 fit with the longer working-day tiers, which start only once verification ends.

M-Pesa basics that affect a payout

Legal deadlines bind the operator, not the mobile money network. Safaricom publishes three M-Pesa limits: KES 250,000 per transaction, KES 500,000 per day, and a maximum account balance of KES 500,000.

Those limits matter for larger wins. A prize above KES 250,000 cannot arrive as one M-Pesa transaction, and a wallet already close to KES 500,000 has little room for an incoming payment. From KES 5,000,001 the Third Schedule requires a bank transfer anyway.

Two items can make the amount you receive smaller than the amount you won. The operator withholds 5% income tax on withdrawals made by punters under the Income Tax Act, Third Schedule, Head B, paragraph 5(i), as explained in withholding tax on betting winnings. Section 72(6)(b) of the Gambling Control Act also requires the licensee to give you the particulars of any processing fee you may incur.

Before depositing, confirm that the paybill or till you are paying belongs to the licensee. That check is set out in M-Pesa betting sites and the licence list.

Money that is not a win

No section sets a number of days for returning an unused balance when you ask for it. Section 75(b) only allows the licensee to remit your balance at your request, and the Third Schedule speaks of prizes.

Two rules deal with idle balances. Section 77(1) requires a licensee to remit the balance to you when no transaction has been recorded on your account for three months. Under section 77(2), money of a player whose whereabouts stay unknown for five years goes to the Unclaimed Financial Assets Authority.

When to complain about a late payout

  1. Let the deadline that applies run out: two days for the credit under section 70(1), then the tier deadline in the Third Schedule.
  2. Write to the operator's customer care centre, which section 68(8) requires an online operator to keep in Kenya. Give the bet ID, the amount, the date of the win and the date you asked to withdraw.
  3. Ask for the matter to go to the regulator if the reply does not fix it. Under r.9(2)(e) of L.N. 112, a complaint left unresolved for 72 hours must be passed to the Gambling Regulatory Authority, and a written request to escalate triggers the same duty.
  4. Call the toll-free line 0800-723-770, as shown on the regulator's website, or use the complaint form on its complaints page.
  5. Watch the calendar. Section 80 lets a party to a dispute arising out of online gambling appeal to the Gambling Appeals Tribunal within fourteen days from the date of the dispute.

Each body's role is explained in how to complain about a betting company. If the operator refuses to pay rather than paying late, read what to do when a bookmaker refuses to pay winnings.

Questions

How long does a betting withdrawal take in Kenya?

The law sets deadlines by prize size. Under the Third Schedule to L.N. 112, prizes up to KES 500,000 are paid immediately after basic identity checks, and prizes up to KES 5,000,000 within five working days. Prizes up to KES 50,000,000 are due within fourteen working days after verification, and jackpots above that within thirty working days after verification.

Is a bookmaker allowed to hold my winnings for more than two days?

The two days in section 70(1) of the Gambling Control Act, 2025 apply to crediting a monetary prize to your betting account. Sending that money on to M-Pesa or a bank follows the Third Schedule to L.N. 112, where the two highest tiers allow fourteen or thirty working days counted from the end of verification.

What penalty does a bookmaker face for paying winnings late?

Regulation 101 of L.N. 112 makes a licensee that fails to pay winnings within fourteen days liable to a penalty of 5% of the total winnings, paid to the Authority. It must also pay the player the outstanding amount plus interest of 5% per day for the next twenty-one days, and non-compliance may lead to suspension of its licence.

Why can a large win not be paid in one M-Pesa transfer?

Safaricom caps a single M-Pesa transaction at KES 250,000 and sets KES 500,000 as both the daily limit and the maximum balance. A payout above those figures cannot be completed as one M-Pesa payment. The Third Schedule to L.N. 112 also allows mobile money or bank transfer from KES 500,001 and requires bank transfer from KES 5,000,001.

When should I complain about a delayed withdrawal?

Once the deadline for your prize tier has passed, write to the operator's customer care centre and keep the reference. Regulation 9(2)(e) of L.N. 112 obliges the operator to pass an unresolved complaint to the Gambling Regulatory Authority after 72 hours, or earlier on your written request. The regulator's website shows a toll-free line, 0800-723-770.
